PLEASE READ CAREFULLY BEFORE SIGNING OR AGREEING.
THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.
In consideration for being permitted to use the facilities, equipment, and services of Muddy Paws DIY Dog Wash Inc. ("the Facility"), I, the undersigned customer ("Customer"), agree to the following terms and conditions:
1. Assumption of Risk
I understand and acknowledge that self-service dog washing, grooming, and handling dogs involves inherent risks. These risks include, but are not limited to: slips, trips, and falls on wet floors; bites, scratches, or injuries from my own dog or other dogs; and injuries related to the use of grooming equipment (such as hydraulic tubs, high-velocity dryers, clippers, and shears). I acknowledge that these risks apply whether I am performing the services myself, receiving assistance from Facility staff, or having staff perform add-on services. I voluntarily assume all risks associated with my use of the Facility.
2. Pet Health & Shop Cleanliness
I acknowledge that while the Facility prefers all dogs to be fully vaccinated, proof of vaccination is not strictly required for entry. I accept any health risks this policy may present to my own animal.
3. Pet Behavior & Safety Policy
I certify that I am strictly liable for the behavior of my dog at all times. If my dog is known to be aggressive, I agree to notify Facility staff prior to bringing the dog into the washing area so that appropriate accommodations can be made. In the event of a bite or injury, I acknowledge that management reserves the right to report the incident to local animal control authorities, particularly if the bite is severe or if the dog poses an immediate and ongoing danger to others.
4. Facility Condition & Inspection
Muddy Paws DIY Dog Wash Inc. strives to maintain a clean, hygienic, and well-functioning environment. However, I agree to visually inspect the tub, grooming area, and equipment prior to use. If I notice any hazards, broken equipment, or unsanitary conditions, I agree to notify staff immediately before bringing my dog into the wash area.
5. Equipment Care & Responsibility
I assume full financial and legal responsibility for any damage to the Facility, grooming equipment, high-velocity dryers, hydraulic tubs, or plumbing caused by my pet, or caused by my own misuse or failure to follow staff instructions regarding the equipment.
6. Facility Rules & Pet Supervision
I agree to maintain control over my dog at all times while on the premises. While the Facility strongly recommends the use of provided tub tethers for safety, I understand that I may opt not to use them provided my dog remains strictly under my physical or verbal control at all times.
7. Photo and Video Release
I grant Muddy Paws DIY Dog Wash Inc. the right to take photographs or video of my pet(s) while on the premises and use them for social media, marketing, and promotional purposes without any further compensation.
8. Release of Liability and Indemnification
To the fullest extent permitted by Washington law, I hereby release, waive, discharge, and agree to hold harmless Muddy Paws DIY Dog Wash Inc., its owners, employees, and agents from any and all claims, liability, loss, damage, or demands—whether caused by the negligence of the Facility or otherwise—arising from my use of the Facility, equipment, or services, including any assistance or add-on services performed by Facility staff.
9. Right to Refuse Service
Muddy Paws DIY Dog Wash Inc. reserves the right to refuse service or ask any customer to leave the premises if the customer or their dog exhibits disruptive or uncontrollable behavior, poses a danger to others, creates an unsafe environment, or fails to abide by Facility rules.
10. Governing Law and Severability
This Agreement shall be governed by the laws of the State of Washington, with jurisdiction resting in Clark County. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By signing in person (or agreeing via digital checkout), I acknowledge that I have read and fully understand this Waiver and Release of Liability. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am agreeing to these terms freely and voluntarily, and intend this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
